Сегодня в мессенджере Whatsapp, мы увидели видео, в котором водитель на основании того, что у инспектора ГИБДД просрочено служебное удостоверение, отказался от предъявления документов на проверку. Прав ли был водитель в данном случае?

В данном случае водитель был не прав и инспектора ГИБДД, вполне могли привлечь его к ответственности за неповиновение законному требованию сотрудника полиции. Давайте разберемся почему.

На видео, после того как остановивший водителя сотрудник ГИБДД попросил предъявить документы, водитель сначала поинтересовался причиной остановки вне стационарного поста ГИБДД - вполне резонный и правомерный вопрос, на что получил ответ, что был остановлен согласно проводимым госавтоинспекцией специальным мероприятиям. Далее, водитель потребовал инспектора ДПС предъявить служебное удостоверение, также вполне законное требование. После того как выяснилось, что удостоверение у инспектора ДПС просрочено, водитель предпринял попытку уехать не предъявляя своих документов. После недолгих разбирательств водителя все таки отпустили не проверив документы. В данном случае, можем сказать, что автолюбителю повезло, так как все могло кончиться не так благополучно.

В соответствии с Приказом МВД России от 02.03.2009 № 185, (на который также ссылался водитель), инспектор ГИБДД действует на основании Правил дорожного движения, ФЗ "О полиции" и некоторых других нормативно-правовых актов. На основании п. 20 Приказа МВД № 185, сотрудник ДПС должен представиться, назвав свою должность, специальное звание и фамилию, после чего кратко сообщить причину и цель обращения. При остановке транспортного средства или пешехода сотрудник, по требованию участника дорожного движения, обязан предъявить в развернутом виде служебное удостоверение, не выпуская его из рук. Как видно, из видео, все это сотрудники выполнили.

Но ведь у инспектора действительно было просрочено удостоверение - как с этим быть? Дает ли это право водителю не исполнять требования таких сотрудников? Полномочия сотрудников полиции и сотрудников ГИБДД в частности, регулируются Федеральным законом "О полиции", Приказом МВД № 185 и КоАП РФ.

Ч. 2 ст. 13 ФЗ "О полиции" гласит, что право останавливать транспортные средства, проверять документы на право пользования и управления ими, документы на транспортные средства принадлежит специально уполномоченным сотрудникам полиции. В соответствии с Приказом МВД № 185, специально уполномоченными сотрудниками являются сотрудники Госавтоинспекции, уполномоченные составлять протоколы об административных правонарушениях в области дорожного движения.

Теперь подходим к самому главному - на основании ст. 25 ФЗ "О полиции", сотрудником полиции является гражданин Российской Федерации, который осуществляет служебную деятельность на должности федеральной государственной службы в органах внутренних дел и которому в установленном порядке присвоено специальное звание . Сотруднику полиции выдаются служебное удостоверение, специальный жетон с личным номером, нагрудный знак , образцы которых утверждаются федеральным органом исполнительной власти в сфере внутренних дел.

В соответствии со ст. 34 ФЗ "О полиции" служба в полиции осуществляется в соответствии Федеральным законом "О службе в органах МВД РФ". Ст. 10 данного закона гласит буквально следующее:

"Статья 10. Сотрудник органов внутренних дел

1. Сотрудник органов внутренних дел - гражданин, который взял на себя обязательства по прохождению федеральной государственной службы в органах внутренних дел в должности рядового или начальствующего состава и которому в установленном настоящим Федеральным законом порядке присвоено специальное звание рядового или начальствующего состава.

2. Сотрудник органов внутренних дел может проходить службу в органах внутренних дел в случае его зачисления в распоряжение федерального органа исполнительной власти в сфере внутренних дел, его территориального органа, подразделения либо в случае прикомандирования, предусмотренного статьей 32 настоящего Федерального закона. При этом сотрудник не замещает должность в органах внутренних дел. Федеральными законами и (или) нормативными правовыми актами Президента Российской Федерации могут быть установлены другие случаи прохождения сотрудником службы в органах внутренних дел, когда он не замещает должность в органах внутренних дел.

3. Правовое положение (статус) сотрудника органов внутренних дел определяется настоящим Федеральным законом и федеральными законами , регулирующими особенности прохождения службы в органах внутренних дел.

4. Сотруднику органов внутренних дел выдаются служебное удостоверение и специальный жетон с личным номером. Образцы служебного удостоверения и специального жетона сотрудника органов внутренних дел и порядок их выдачи утверждаются федеральным органом исполнительной власти в сфере внутренних дел. Служебное удостоверение сотрудника органов внутренних дел является документом, подтверждающим личность сотрудника, его принадлежность к федеральному органу исполнительной власти в сфере внутренних дел, его территориальному органу или подразделению, должность и специальное звание сотрудника . Служебное удостоверение сотрудника органов внутренних дел подтверждает его право на ношение и хранение огнестрельного оружия и (или) специальных средств, иные права и полномочия, предоставленные сотруднику законодательством Российской Федерации"

Таким образом, на основании вышеперечисленных норм закона, сотрудником полиции является гражданин РФ, который проходит службу в рядах полиции, а служебное удостоверение является только подтверждением его полномочий, при этом действительность сотрудника полиции, его полномочия не ставятся в зависимость от срока действия служебного удостоверения. Удостоверение личности как и нагрудный жетон только подтверждают его полномочия и принадлежность к полиции.

Если водитель сомневается в том, действительно ли данный инспектор является сотрудником полиции, он вправе обратиться в дежурную часть ГИБДД и уточнить, действительно ли данный инспектор является действующим сотрудником полиции. Но факт просроченного удостоверения у инспектора ДПС не означает того, что водитель вправе не исполнять законного требования такого сотрудника полиции. Так как в соответствии с п.п. 2.1. и 2.1.1. Правил дорожного движения, водитель механического транспортного средства обязан , иметь при себе и по требованию сотрудников полиции передавать им, для проверки водительское удостоверение .

Цвет зависит:
красный - от должности
зеленый или синий - от звания.

Зеленый фон и сейчас есть у пограничной службы, красный у тех, кто имеет звание от полковника и выше.
Удостоверения на желтом фоне - без разрешения на ношение огнестрельного оружия, а именно выдают гражданскому персоналу.
От рядового до старшего прапорщика, включая курсантские удостоверения сероватого цвета (например водители). От лейтенанта до капитана (включительно) синие - должности например, оперативники и сотрудники. Старший офицерский состав (начальники и заместители начальников отдела) - розоватые.

Нумерация:
Номер удостоверения и личный номер шестизначный. Только личный номер еще имеет букву впереди С, Е и даже ЕА.

Примечания:
- у внештатного сотрудника ФСБ удостоверения такие же, но без разрешения на ношение огнестрельного оружия. Удостоверения внештатных сотрудников "пробиваются" через дежурку управы своего округа, поскольку указанные должности присутствуют в официальном штатном расписании конторы.
- у курсантов Академии ФСБ присутствует слово "Академия" (справа вверху "Академия Федеральной службы безопасности"), остальное в том числе надпись про оружие, идентично служебному удостоверению сотрудника.

Надпись про оружие во всех удостоверениях, причем вне зависимости имеется личное оружие, или нет.

Удостоверения выдаются только аттестованным сотрудникам, у не аттестованных только пропуска.
Кроме того в большинстве управлений на постоянном ношении удостоверения находятся только у оперативных сотрудников. Остальные сотрудники (кадры и прочие) получают удостоверения при входе в здание и сдают при выходе. На постоянном ношении у всех есть пропуска, утеря или кража которых не так страшна, как например удостоверения.

Каждый гражданин знает, что сотрудник полиции — лицо должностное, он имеет массу прав, недоступных обычному человеку. Однако эти же права накладывают на него массу ответственности. Так, например, должностные лица значительно больше (в 3 — 5 раз) платят за нарушения правил ПДД, к ним можно применить особые меры наказания (например, превышение должностных полномочий), за ними постоянно следят различные контролирующие органы.

Одним из самых первых вопросов при встрече с полицейским является «Должен ли сотрудник полиции предоставить свои документы?». Прежде, чем ответить на этот вопрос, сначала рассмотрим то, какие документы у полицейского должны быть.

Самый важный документ для любого полицейского — его удостоверение. Это небольшая красная книжечка, содержащая в основном номера — идентификаторы. Из информации о владельце там имеется только ФИО и фотография. Удостоверение имеет следующий вид:

• Левая половина — фотография, эмблема государственного органа, личный код, дата действия удостоверения, голографическая наклейка;
• Правая половина — номер удостоверения, должность сотрудника, ФИО сотрудника, печать подразделения, штрих — код, дата выдачи удостоверения, подпись руководителя отдела, в котором удостоверение выдано.

Удостоверение — самый главный документ сотрудника полиции. Без него полицейский — обычный человек, не имеющий прав, положенных ему по долгу службы. Остальные же документы, которые должен предоставить сотрудник полиции, зависят от обстоятельств, по которым сотрудник к вам обратился. Например, для обыска потребуется ордер, а для ареста — постановление суда.

Должен ли полицейский предъявить вам свое удостоверение при обращении?

Да. Это его обязанность. Однако сотрудник полиции обязан показывать свои бумаги только в том случае, если вы их у него попросите — он не должен подходя к вам держать перед собой раскрытое удостоверение.

Так же сотрудник полиции при обращении должен сообщить вам ФИО и занимаемую им должность. После этого он обязан назвать вам причину обращения и, если она веская или предполагает применение к гражданину каких либо мер, предоставить бумаги, эти причины или меры поясняющие и подтверждающие.

В некоторых случаях сотрудник не обязан предварительно показывать свои документы. Возникают такие случаи в особых ситуациях, когда сотрудник полиции не может обратиться к гражданину без риска. Например, при оперативном задержании. Стоит отметить, что все эти меры согласованы судом и полностью законны. Однако обычным гражданам с такими мерами, как правило, сталкиваться не приходится.

Когда еще сотрудник не обязан показывать документы?

Сотрудники полиции не должны предъявлять свое полицейское удостоверение в том случае, если гражданин обращается к ним за помощью. У простых граждан нет возможности проверки документов у должностных лиц просто по желанию. Это указано в законе «О полиции». При обращении к сотруднику полиции он должен будет только представиться и назвать свою должность, а так же оказать помощь в рамках своей компетенции.

Стоит отметить, что у полицейских тоже есть права, и они легко могут быть нарушены простыми гражданами. Зачастую отказ предоставить документы при обращении к сотруднику полиции ошибочно расценивается как нарушение законодательства и влечет за собой жалобы в МВД и подобные инстанции. Такие жалобы не правомерны.

Как должны вести себя сотрудники полиции при общении с гражданами?

Большой вопрос вызывает то, как сотрудники полиции вообще должны себя вести. На самом деле есть отдельное постановление, описывающее вид и характер общения между сотрудниками полиции и простыми гражданами, действующими как в случае обращения полицейского к гражданину, так и при обращении гражданина к полицейскому. Описано оно в части пятой «Закона о полиции» и гласит следующее:

• Сотрудники полиции должен уважать права других граждан;
• Общение должно проводиться без унижения чести и достоинства, диалог должен быть уважительным;
• Сотрудники полиции должны действовать только в рамках своих полномочий;
• Сотрудники полиции должны оказывать всю необходимую посильную помощь;
• Личная информация граждан, переданная сотрудникам полиции в ходе выполнения их обязанностей, не должна разглашаться.

Стоит отметить, что это правило распространяется не только на полицейских, но и на любые правоохранительные органы. От граждан, общающихся с полицейскими, ожидается то же самое.

Что делать, если сотрудник полиции не предъявляет документы?

Если остановивший вас сотрудник полиции либо не показал по требованию удостоверение, либо ведет себя неподобающим образом, то вы имеете полное право подать на него жалобу. В этом случае стоит подать на него жалобу. Для этого узнайте его ФИО и номер отделения, за которым он закреплен. Если в отделении вашу жалобу не приняли, то обратитесь в прокуратуру.

Бывает и так, что сотрудник не только не показывает документы, но и не представляется. В этом случае вы можете вызвать полицию. Разобраться в ситуации должен уже второй полицейский. Весьма вероятно, что первый «сотрудник полиции» — мошенник.
